I want to divorce – what do I need to deal with?
5 tasks in suggested order
1. Determine whether the conditions for an administrative or notarial divorce are met, or whether court proceedings are required, and start the correct procedure.
After the decision to divorce has been made and you have the necessary documents.
The civil-status officer, notary public or competent court, depending on the conditions in your case.
Marriage certificate, identity documents, agreements and documents concerning the children.
The procedure is not chosen solely by preference; minor children, mutual agreement and other circumstances affect which route is available.

2. If you have minor children, agree on or ask for decisions on parental authority, the child’s home, personal contact and child maintenance.
As part of or before the procedure, depending on the route chosen.
Notary or court; social services may be involved in assessing the child’s best interests.
The children’s documents, parenting proposal, income, expenses and housing conditions.
Any parental agreement is assessed against the best interests of the child.

3. Deal separately with jointly owned property, debts, loans and use of the home, and register any real-estate transfers in the land register.
By agreement or in separate proceedings, before or after the divorce.
Notary/court, bank and ANCPI/OCPI depending on the type of asset.
Inventory of assets and debts, contracts, land-register extracts and valuations.
Divorce does not automatically remove a former spouse from a loan or automatically transfer ownership.

4. If your surname changes after the divorce, apply to update your identity documents, passport, driving licence and other relevant records.
After the divorce act/judgment becomes final, within the deadlines that apply to each document.
Personal-records service, passport service, driving-licence authority and other issuing authorities.
Divorce certificate or judgment and your existing documents.
A surname change does not automatically propagate to all documents and contracts.

5. Report changes in household composition and address wherever they affect benefits, taxes, insurance, rent or joint contracts.
After the legal or factual change, before the next payment.
AJPIS/town hall, ANAF, employer and the providers of your own contracts.
Divorce document, agreements, new address and file/contract numbers.
Check each entitlement separately; divorce does not automatically update payments.
