I want to work legally in Poland – do I need a work permit?
4 tasks in suggested order
1. First check whether a work permit is required, whether you have free access to the labour market, a statutory exemption or another simplified basis.
Before starting the permit procedure.
MOS / official rules on employment of foreigners.
Citizenship, residence status, type of work and employer.
Since 2025, employment of foreigners has been governed by the new Act of 20 March 2025. Always check the current exemptions and the correct procedure before starting the process.

2. If a permit is required, the employer identifies the correct permit type and submits the appropriate application electronically to the competent authority.
Before legally starting work in a route that requires a permit.
The employer files electronically. For a typical permit, the voivode is competent according to the employer's registered office or permanent residence; for seasonal work the starosta is competent on the same basis; posting has separate jurisdiction rules.
Employee, position and employment-condition details.
In a typical work-permit procedure, the employer is the applicant, not the foreign worker.

3. At the same time, make sure you have lawful stay on a basis that allows you to work in Poland.
Before starting work and throughout employment.
MOS / residence document.
Visa, residence card or another basis of lawful stay.
A work permit alone does not legalise your stay. You must also be staying in Poland legally on a basis that allows you to work.

4. Start and perform work under the conditions covered by the correct legal basis and respond to changes that require a new procedure.
After the conditions for legal work are met.
Employer / competent authority.
Document confirming the legal basis for work and stay.
The right to stay and the right to work are two separate requirements. Throughout employment, both must be satisfied whenever they are required in your situation.
